扶养关系

本法所说的子女，包括婚生子女、非婚生子女、养子女和有扶养关系的继子女。

The " children " referred to in this Law include legitimate children , illegitimate children and adopted children , as well as step-children who supported or were supported by the decedent .

本法所说的兄弟姐妹，包括同父母的兄弟姐妹、同父异母或者同母异父的兄弟姐妹、养兄弟姐妹、有扶养关系的继兄弟姐妹。

The " brothers and sisters " referred to in this Law include blood brothers and sisters , brothers and sisters of half blood , adopted brothers and sisters , as well as step-brothers and step-sisters who supported or were supported by the decedent .

家庭成员是指具有法定赡养、抚养或扶养关系并共同生活的人员。

Family members refer to persons who have statutory relationships of supporting parents , children and spouse and live together .

前项以外与投保人有抚养、赡养或者扶养关系的家庭其他成员、近亲属。

Other family members or close relatives , apart from the aforementioned , who have relations of fostering , supporting and maintaining with the applicant .

明确规定形成扶养关系的继父母子女关系是法律上的拟制血亲关系，但就其是否因再婚关系的消灭而解除，应视不同情况而定。

Explicitly stipulate that the relation of the step parents and the step children forming maintenance relation between them is the legal fiction blood relative relations .

相关立法应以权利义务相一致原则为宗旨，夫妻扶养关系应与夫妻其他人身财产关系相联系。
