反向假冒商标行为是指在他人的商品上擅自使用自己商标的行为。

The act of opposite shamming trademark refers to the unauthorized use of one 's own trademark on others ' commodities .

然而新类型的商业混同行为，如不正当模仿行为、反向假冒商标行为以及商标与企业名称的混同行为等却因为法无明文规定而得不到有力的规制。

However , the law regulation is weak against new types of commercial misappropriation such as unfair imitation , reverse passing-off or misappropriation of trademark or company names for lack of express provision .

各国不同的立法模式告诉我们，只要法律之间关系和谐，都能收到较好的规制反向假冒商标行为的功效。

The fact that there are different systems of legislation in various countries tells us that as long as the relationships between different laws are in harmony , a better effect in regulating the reverse passing off will be achieved .

Trips协议下我国假冒注册商标罪的立法应从以下方面加以完善：将服务商标、类似商品、近似商标侵权行为和反向假冒注册商标行为纳入本罪的保护范围；

On the basis of Trips , legislative perfection of the crime of shamming registered trademark as follows : bring service trademark , resembling commodity , approximate trademark and opposite shamming into the protection area of the crime ;
